<p>中新网12月16日电修改后的中国《全国年节及纪念日放假办法》，以及新出台的《职工带薪年休假条例》，将从2008年1月1日起施行。这两个备受瞩目的法规预计将对中国人的假日生活和中国的假日经济带来巨大的影响。

中国媒体今天公布了这两个法规的全文。本月7日，国务院第198次常务会议便已经通过了关于修改《全国年节及纪念日放假办法》的决定，以及《职工带薪年休假条例》。</p>
<p>　　不出媒体早前报道所料，《全国年节及纪念日放假办法》主要的修改之处，一是"五一"劳动节只放假1天，使老百姓从此告别"五一"黄金周。二是增加了清明节、端午节和中秋节三个传统节日，各休一天。另外，春节的休假提前一天，从农历除夕开始，正月初三不再是法定休假日。</p>
<p>　　在对"黄金周"大动手术之外，被人们寄予厚望的正是《职工带薪年休假条例》。按照这一条例。机关、团体、企业、事业单位、民办非企业单位、有雇工的个体工商户等单位的职工，连续工作1年以上，就可享受带薪年休假，休假期间享受与正常工作期间相同的工资收入。</p>
<p>　　具体而言，"职工累计工作已满1年不满10年的，年休假5天；已满10年不满20年的，年休假10天；已满20年的，年休假15天"。不过，"国家法定休假日、休息日不计入年休假的假期"，而且，"一般不跨年度安排"。对职工应休未休的年休假天数，单位应当按照该职工日工资收入的300%支付年休假工资报酬。</p>
<p>　　同时，该条例对不享受当年年休假的若干情形作了规定，诸如：寒暑假休假天数多于年休假天数的，请事假累计20天以上且单位按照规定不扣工资的，以及请病假累计超过相应天数的。</p>
<p>　　1999年起，中国确定了每年三段七天长假(春节、"五一"、"十一")，以刺激旅游、购物、休闲、娱乐等消费活动，拉动内需，从而显著提升国民经济。而亿万人集中休假、出游、消费，的确带来了滚滚财源，因而这种休假制得享"黄金周"之誉。</p>
<p>　　但近年来，"黄金周"却受到舆论越来越多的诟病。媒体和学者列举了"黄金周"若干"罪状"，诸如：使商家的短期成本剧增，使消费者所享受的服务质量明显下降，使政府公共管理费用增加，对自然景观和历史文化遗迹带来很大压力，刺激境外游的同时对国内经济的拉动作用却逐渐降低，等等。</p>
<p>　　11月9日，中国官方公布法定节假日调整方案，向公众征询意见。方案中，增加传统节日的做法得到了近乎一致的认同，而牺牲"五一"黄金周的安排却引发极大争议。而全国政协委员、清华大学假日改革课题组负责人蔡继明教授则表示，假期调整利大于弊，如果条件成熟，他建议进一步取消"十一"长假。</p>
<p>　　另一方面，事实上，中国宪法早就确定职工的"休假制度"，1994年颁布的《劳动法》规定，"国家实行带薪年休假制度，劳动者连续工作一年以上者，享受带薪年休假"。但由于缺乏带有法规性的实施细则和具体的落实措施，不论是国家机关还是企事业单位，只有少数地方、少数部门、少数企业实行带薪休假。
　　中国对公民休假制度的改革也引发海外媒体关注。有海外报章曾评论说，从实施"黄金周"时的经济属性优先，到打破"黄金周"时的环境生态属性优先和民本属性优先，从中可以窥见中国的进步，值得首肯。</p>
